Terms of Service

• You must be at least 18 years old to use the Services.

• You may use the Services as an individual or on behalf of a company or agency.

• Agency accounts are permitted and encouraged; however, account sharing between individuals is prohibited.
  Team members may be added based on your plan’s allocated seats.

• You are responsible for all activity that occurs under your account and must keep your login credentials secure.

• You agree to provide accurate, current, and complete information during registration and to keep it up to date.

AffiliateFinder.ai provides software-as-a-service tools for affiliate and influencer discovery, research, and automation, including integrations and API access.

We provide the platform and underlying technology, but we do not guarantee that use of the Services will result in affiliate sales, conversions, or specific business outcomes.

We may add, remove, or modify features at any time to improve functionality or security.

• Free Trial: New users receive a 7-day free trial before the first billing cycle.

• Billing: Subscriptions are billed through Stripe on a monthly or annual basis, depending on the plan selected.

• Auto-Renewal: Plans renew automatically at the end of each billing period unless canceled prior to renewal.

• Cancellation: You may cancel at any time through your account settings. Access continues until the end of the current billing cycle.

• Refunds: Refunds are generally not provided after the free trial, except where required by law.

• Taxes: All prices exclude applicable taxes, which will be added where required.

• Non-Payment: We may suspend access to your account if payment is not successfully processed.

• Your Data: You retain full ownership of all data you upload or generate through the Services. You grant us a limited, revocable license to process, store, and display that data solely for providing the Services.

• Our IP: All software, algorithms, designs, and branding remain the exclusive property of Affiliate Finder Ltd.
  You may not copy, reverse engineer, or re-sell the platform or its data.

• Generated Outputs: Any AI-generated or automated outputs (e.g., affiliate suggestions, lead lists) are licensed to you for business use but are provided without warranty.

• Feedback: By submitting feedback or suggestions, you grant Affiliate Finder a royalty-free, perpetual license to use that input for improving our Services.

You agree not to:

1. Use the Services for unlawful, fraudulent, or deceptive purposes.

2. Use data from AffiliateFinder.ai for spam, illegal marketing, or harassment.

3. Re-sell, sublicense, or offer the Services as a competing product.

4. Scrape, clone, or reproduce any data or code from the platform.

5. Interfere with or disrupt the integrity, performance, or security of the Services.

Both you and Affiliate Finder agree to treat non-public business, technical, and financial information disclosed under this relationship as confidential.

Confidential information does not include data that:

• Becomes public through no fault of the receiving party;

• Was already lawfully known before disclosure; or

• Must be disclosed by law, court order, or government authority.

We use commercially reasonable efforts to maintain 99% uptime for the Services. Maintenance windows or upgrades may occasionally cause temporary interruptions.

Affiliate Finder is not liable for downtime caused by third-party providers, force majeure events, or circumstances beyond our reasonable control.

• By You: You may cancel your subscription at any time through your account dashboard. Access continues until the end of your current paid period, after which the subscription will not renew.

• By Us: We may suspend or terminate your account for non-payment, breach of these Terms, or use of the Services for illegal marketing or prohibited activities.

• Data Retention: Upon termination, we may retain minimal billing and transaction data for legal compliance. Other user data may be deleted or anonymized.

To the maximum extent permitted by law:

• Affiliate Finder Ltd and its directors, employees, and affiliates shall not be liable for any indirect, incidental, consequential, special, or punitive damages, including lost profits or data.

• Our total cumulative liability for any claim shall not exceed the greater of £500 or the total subscription fees paid by you in the 12 months preceding the claim.

Some jurisdictions do not allow certain limitations; in such cases, those limitations apply only to the extent permitted
by law.

You agree to indemnify, defend, and hold harmless Affiliate Finder Ltd, its officers, employees, and agents from and against any claims, damages, liabilities, and expenses arising from your use of the Services or violation of these Terms, except to the extent caused by our gross negligence or willful misconduct.

These Terms are governed by the laws of England and Wales.
Both parties consent to the exclusive jurisdiction of the courts of England and Wales to resolve any disputes arising from or related to these Terms.

For enterprise customers, alternative dispute resolution or arbitration may be arranged by mutual agreement.

We may update or modify these Terms from time to time.When we make material changes, we will notify users via email or in-app notice at least 7 days before the changes take effect.Your continued use of the Services after the effective date constitutes acceptance of the updated Terms.

Enterprise customers are automatically bound by these Terms unless a separate, signed Enterprise Agreement or Master Service Agreement (MSA) is executed, in which case the terms of that agreement will prevail.

A Data Processing Addendum (DPA), Service Level Agreement (SLA), and subprocessor list are available upon request to enterprise clients.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Affiliate Finder Ltd concerning your use of the Services and supersede all prior agreements or communications on the subject.
